Filed in New Jersey on June 14, 2018, the first case involving recently recalled Taytulla birth control pills brings to light the true physical and emotional toll that can be exerted on an individual by an unintended pregnancy. Represented by the law firms Baron, Herskowitz, and Cohen and Chaffin Luhana, the plaintiff alleges that the birth control pills manufactured by Allergan USA, were out of the proper sequence and therefore not protecting the individual against pregnancy. The medication’s sample packs were distributed to doctor’s offices throughout the U.S.
Ultimately, the product (specifically lot #5620706) was deemed defective and dangerous, as the pills containing hormones and those that were just placebo pills were mis-ordered within the “blister pack” — misleading the user into believing that they were correctly following the protocol that’s necessary for product effectiveness. While this lawsuit represents only one individual who has had to bear the consequences of a blatant mistake made by the manufacturer, there are many more victims as the product has an extended use-by date and many sample packs have already been freely distributed— a typical practice by doctors. There are approximately 170,000 incorrect sample packages distributed.
